Welcome to the Gillian Ragan Foundation. By accessing or using this website (gillianraganfoundation.org), participating in our programs, donating, bidding in our auctions, or otherwise interacting with the Foundation online, you agree to these Terms of Service. Please read them carefully.
1. About the Foundation
The Gillian Ragan Foundation is a registered 501(c)(3) nonprofit organization based in Arizona, dedicated to supporting families who have suffered the loss of a child and raising awareness around mental health. References to “we,” “us,” or “our” in these Terms mean the Foundation.
2. Use of the Site
You agree to use the site lawfully and respectfully. You will not:
- Attempt to disrupt or compromise the security of the site or its users.
- Use the site to harass, threaten, or harm others, particularly given the sensitive nature of grief content shared here.
- Submit false, misleading, or unlawful information through any form on the site.
- Copy, scrape, or republish substantial portions of site content without permission.
3. Donations
All donations made through the site are processed securely by Stripe. Donations to the Gillian Ragan Foundation are tax-deductible to the fullest extent allowed by U.S. law. You will receive an emailed receipt for your records.
Refunds. Donations are generally non-refundable. If you believe a donation was made in error (for example, a duplicate charge or an unauthorized transaction), please contact us within 30 days and we will work with you to resolve the issue.
4. Healing Assistance Program
Our Healing Assistance Program offers limited financial support to families pursuing grief healing services. Submitting an application does not guarantee approval. Award decisions are made at the sole discretion of the Foundation based on need, available funds, and program guidelines.
Important: Information shared on the site, including resources, partner listings, and program materials, is provided for informational and supportive purposes only. It is not a substitute for professional medical, mental health, legal, or financial advice. If you are in crisis, please call or text 988 (the Suicide & Crisis Lifeline) or call 911.
5. Auctions, Sponsorships & Events
Auctions, sponsorships, and ticketed events have their own specific rules, which will be posted with each item or event. By participating, you agree to those additional rules. Bids placed in our auctions are binding offers, and successful bidders agree to pay the full bid amount plus any applicable shipping or handling.
6. Tributes & User Submissions
When you submit a tribute, photo, story, or other content (a “Submission”) for publication, you represent that:
- You own or have permission to share the Submission, including any photos of others.
- You grant the Foundation a non-exclusive, royalty-free, worldwide license to display, reproduce, and share the Submission on our website and related Foundation communications, in remembrance of your loved one.
- You may request that your Submission be edited or removed at any time by contacting us.
The Foundation reserves the right to decline or remove any Submission that we believe is inappropriate, harmful, or inconsistent with our mission.
7. Intellectual Property
The site’s content — including the Foundation’s name, logo, photos, written materials, and design — is owned by the Gillian Ragan Foundation or used with permission, and is protected by copyright and trademark law. You may share links to our pages and quote brief excerpts with attribution. Other uses require our written permission.
8. Third-Party Links & Resources
Our Resources and Partners pages link to organizations we believe may be helpful to grieving families. We do not control these third parties and are not responsible for their content, services, or practices. Inclusion of an organization is not an endorsement of every aspect of their work.
9. Disclaimer
The site and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Foundation disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, the Gillian Ragan Foundation, its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising out of or related to your use of the site or participation in our programs.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Foundation from any claim or demand made by a third party arising out of your misuse of the site, your violation of these Terms, or your violation of the rights of another.
12. Privacy
Your use of the site is also governed by our Privacy Policy, which explains how we collect and protect your personal information.
13. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the site will be resolved in the state or federal courts located in Maricopa County, Arizona.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the site after changes are posted means you accept the updated Terms.
